Dog Purchaser Protection Act – Puppy Lemon Law Public Notice (State of PA)

(1) A seller shall provide you with a health record for the dog at the time of sale. The health record must contain information as required by the law.

(2) The seller shall provide a health certificate issued by a veterinarian within 21 days prior to the date of sale or a guarantee of good health issued and signed by the seller. The health certificate and the guarantee of good health must contain information as required by the law.   

(3) To preserve your rights under the law, you must take your newly purchased dog to a licensed veterinarian for examination within 10 days of purchase. If a veterinarian determines, within 10 days of purchase, that your dog is clinically ill or has died from an injury sustained or illness likely to have been contracted on or before the date of sale and delivery, you have the following options

(i) Return the dog for a complete refund;

(ii) Return the dog for a replacement dog of equal value; or

(iii) Retain the dog and receive reimbursement for reasonable veterinary fees, not exceeding the purchase price. These options do not apply where a seller, who has provided a health certificate issued by a veterinarian, discloses in writing at the time of sale the health problem for which the buyer later seeks to return the dog.

(4) If, within 30 days of purchase, a licensed veterinarian determines that your dog has a congenital or hereditary defect which adversely affects the animal’s health or that your dog died from a congenital or hereditary defect, you have the same options as outlined in section 3 (above).

(5) Within 2 business days of a veterinarian’s certification of your dog’s illness, defect or death, you must notify, in writing, the seller of the name, address and telephone number of the examining veterinarian. Such notice shall be effective upon depositing the same in the United States mail or upon other service which provides the seller the required information. Failure to notify the seller within 2 business days will result in forfeiture of rights.

(6) Refunds or reimbursements shall be made no later than 14 days after the seller receives the veterinarian certification. Veterinarian certification shall be presented to the seller not later than 5 days after you receive it.

(7) Registerable Dogs—If the seller does not provide within 120 days all documentation to effect registration, you may exercise one of the following options:

(i) Return the dog and receive a full refund of the purchase price; or

(ii) Retain the dog and receive a 50% refund of the purchase price.

(8) If registerable, the seller shall provide at the time of sale: the breeder’s name and address, the name and registration number of the dam and sire, and the name and address of the pedigree registry organization where the dam and sire are registered.

 

By my signature below, I acknowledge that I have received, read, and understand a copy of the Dog Purchaser Protection Act/Puppy Lemon Law, enclosed in my puppy care kit, and as it appears above, and have also observed it displayed conspicuously in the breeders place of business, where I filled out my paperwork for the puppy.

Guarantee of Good Health

Daublands Labradors warrants that the dog being sold is apparently free of, and does not exhibit any signs of, any contagious or infectious disease, is apparently free from and does not exhibit any signs of any defect which is congenital or hereditary; and does not exhibit any signs of a parasitic infestation on the sale of this date.

 

We honor our refund and replacement policy through the Dog Purchaser Protection Act-Puppy Lemon Law as stated and reviewed in this puppy care kit. 

I have received and reviewed a copy of the Dog Purchaser Protection Act-Puppy Lemon Law.____________

 

If for any reason there is a congenital and/or genetic defect within 30 days of purchase, as required by law, and the dog’s life is threatened, and it cannot be surgically corrected at your expense:

(1)      The dog must be humanely put to sleep and we must receive a letter from your veterinarian

(2)      We reserve the right to get a second opinion by a veterinarian of our choice.  Expenses in such case are to be paid by dog owner, not by the breeder.  This option is only available where surgery will correct the condition.

 

After these qualifications have been met and the condition cannot be corrected by surgery or the expense is too much for the owner of the dog, you may choose a replacement puppy of equal value if available or pay the difference if you desire a more expensive puppy.  No cash refunds will be given. 

 

Our guarantee does not include poisoning, reproductive problems (regardless if the puppy is sold with full registration), cancer (as it is not either congenital or genetic), we do not guarantee dental expenses (due to over bites or under bites), accidents, or behavioral problems as training techniques and environments vary.  There also no guarantee of breedibility (regardless of full registration), show quality, size, coat quality, temperament, or adaptability.

 

All puppies will be sold with Limited AKC registration (meaning the offspring of the can NOT be registered with the AKC) unless prior arrangements have been made for full registration with Daublands Labradors.  All dogs sold with full registration are of extra cost and shall carry Daublands Labradors prefix on their registration papers.

If you no longer can keep your Labrador, the buyer must return the puppy/dog to the breeder and the breeder has first choice to either take the Labrador back or help assist in re-homing the puppy/dog.  In either case, the breeder is not obligated to take to Labrador back or refund the purchase price.

If you have a male whose testical has not completely descended when you pick the puppy up at 8 weeks old, which is very common, and it does not fully descend by 6 months of age, Daublands Labradors will refund $100.00 towards the extra cost of the neuter with a copy of the vet bill.

 Puppies microchips MUST be registered no more then 30 days after the purchase date.

All puppies must be given bottled spring water for the first 2 weeks of age.  After the first 2 weeks, you may then gradually mix the bottled water with your water source to help avoid ailments (such as diarrhea, vomiting, etc). In the event, the puppy develops diarrhea or vomiting in the first 10 days after purchase, the purchaser MUST contact the breeder first, before contacting the veterinarian, in order to prevent unnecessary costs to you, and to help you work through “common” reasons for this condition (such as change of surroundings, stress, food, water, etc.)

As the purchaser, I have read and understand the above guarantees and information regarding this puppy and agree to this document in full. Failure to comply with conditions described in this document shall render this contract void.  The buyer and seller agree that all disputes concerning our guarantee must be settled in Lebanon County, PA and are governed under the PA state dog law.  As the purchaser, I also understand that this guarantee is only good for the person signing below and is not meant to be transferred to anyone other than the original owner to whom Daublands Labradors originally transferred the puppy to.
